Privacy Policy

This Privacy Policy sets out the manner in which the Company collects, stores, processes, and shares the personal information provided by you for the use of the Platform and for the purpose of availing the Services, as may be required by the Company or by the Lending Partners (“Information”). Please read the Privacy Policy carefully. If you do not agree to any of the terms of the Privacy Policy, please do not use or access the Platform.

Use and access to the Platform is subject to the terms and conditions (“Terms”), and the Privacy Policy shall be read to form part of the Terms. Capitalized terms used in this Privacy Policy shall have the same meaning ascribed to them in the Terms. By using the Platform, you shall be deemed to have read, understood and accepted the terms of the Privacy Policy and the Terms (described below).

At Kyvu, we are committed to protecting your privacy and securing the Information, by ensuring high standards of data security, employing best practices for data protection, and complying with applicable laws and regulations in respect of your Information. This Privacy Policy and the Terms are governed by and are compliant with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable rules and regulations related to protecting the privacy of your Information.

 

Information Collected:

In order to provide the Services and operate the Platform, the Company and/or the Lending Partner are required to collect, store, or use the following types of Information, including but not limited to: Aadhaar number and information (from you and/or from the Central Identities Data Repository), PAN card information, third party credit bureau reports, salary slips, expenditure and transaction-related data, debit or credit card information, images (uploaded by you), a copy of the Loan Agreement and addendums, if any, and other financial and credit information relating to you, including but not limited to bank details, account information and other details.

 

Disclosure of Information:

The Company will not sell or offer your Information to any third-parties, for any reason. However, we may be required to disclose Information to governmental and regulatory authorities, our business partners including Lending Partners, our advisors and internal administrators who will be subject to strict confidentiality obligations, and to any third-parties who acquire our assets or business.

In the event of any disclosure of your Information, including in the case of any disclosures to governmental and regulatory authorities or any third-parties who acquire our assets or business, we will endeavour to disclose such limited Information as may be necessary.

You agree that, by providing any Information, you have accepted the Terms and this Privacy Policy, and shall not make any claims or dispute the use of the Information in the manner provided herein, including in respect of any act or omission of any third-party to whom the Information is disclosed either by the Company or by you.

 

Retention:

The Company will retain your Information only for as long as you remain registered on our Platform and Services, and until the Outstanding Amount(s) remain due and payable by you. We may also be required to retain your Information for the purposes of complying with legal obligations or for settling any claims or grievances. In every case, we will endeavour to retain only such Information which is required and necessary for such purposes, and for such duration until the purposes are met or are no longer applicable. Upon a specific written request, we will delete your Information within a reasonable amount of time, subject to the requirements set out herein, and subject to any back-ups that we may be required to preserve for complying with statutory and contractual obligations.

 

Data Security:

In order to protect and secure your Information, we implement adequate measures as per standard industry practices. However, cyberattacks and data security risks are always subject to continuous development and improvement, and we do not take any liability or responsibility for any hacking, viruses, or other issues resulting in the loss of your Information. You understand that you are responsible for any actions not attributable to the Company which result in a breach of your Information, including use of any unauthorized or modified software or hardware for accessing the Platform, any inaccuracy or delay in updating the Information, or sharing of any credentials or Information with any other person.

 

Communications:

The Company may be required to send you updates and information relating to your use of the Platform and the Services, and you hereby provide your consent to receiving such communications at the phone number, email address, or address provided by you during registration on the Platform. The Company may additionally contact you to update you on any offers, benefits, rewards and marketing material relating to new products and services launched by the Company or its service partners.

Liability:

You agree to indemnify the Company and its service partners and each of their affiliates, representatives, officers, employees, and partners from any claims made by any third-parties (including any governmental or regulatory authorities) relating to your Information and any content submitted by you on or through the Platform, any breach by you of the Terms and this Privacy Policy, and any violation by you of the rights of any other person or user of the Platform.

You agree that the Company shall not be liable or responsible for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of opportunity, profits, goodwill, use, data, information, details or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Platform or the Services; (ii) unauthorized access to or alteration of your Information; (iii) failure or delay in providing the Services or access to the Platform; (iv) any performance or non-performance by the Company; (v) any damages to your property as the result of your use of the Platform; and (vi) server failure or otherwise.

 

Miscellaneous:

This Privacy Policy shall be governed by and under the laws of India, and shall be subject to the exclusive jurisdiction and venue of the High Court of Delhi.

The Company may be required to update this Privacy Policy from time to time. By continuing to use and access the Platform and the Services, you shall be deemed to have accepted the Privacy Policy as amended from time to time.
